ACC Provides Info About EPA Oil Spill Prevention Rule

If your dealership is near a navigable creek, stream or other waterway and stores oil, oil sludge, waste oil or fuel oil, the EPA Spill Prevention, Control, and Countermeasure (SPCC) regulation, which takes effect in November, applies to you.

CRYSTAL LAKE, Ill.If your dealership is near a navigable creek, stream or other waterway and stores oil, oil sludge, waste oil or fuel oil, the EPA Spill Prevention, Control, and Countermeasure (SPCC) regulation, which takes effect in November, applies to you.

Automotive Compliance Consultants (ACC) reminds dealers that this regulation affects dealers near navigable waters or adjoining shorelines if their individual, aggregate above-ground oil storage capacity is greater than 1,320 U.S. gallons or completely buried storage capacity greater than 42,000 U.S. gallons.

“This regulation is one of those too easily set aside for later, but the Nov. 10, 2011 deadline will be here soon. Now is the time for dealers to obtain the proper EPA paperwork and guidelines and start calculating and cataloging how SPCC impacts them,” said Terry Dortch, president of ACC.

Dealers may contact ACC for a PDF version of this EPA guide and paperwork.

Dealerships that meet regulation criteria and have storage capacity greater than 10,000 gallons must have their SPCC plan certified by a professional engineer prior to its submission to EPA, by Nov. 10. Dealerships near navigable waters but with storage of less than 10,000 gallons may self-certify their compliance. ACC can assist dealers with either certification process.
